By accessing or using the StackWell website and cash back platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time. Material changes will be posted on our website, and your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

You may create only one StackWell account per person. Creating multiple accounts to earn additional cash back, exploit promotions, or circumvent account restrictions is strictly prohibited and will result in the termination of all associated accounts and forfeiture of any pending cash back balances.

Cash back rates are set by our merchant partners and affiliate networks and are subject to change at any time without notice. The rate displayed at the time you click through to the merchant is the rate that will apply to your purchase, provided the transaction is tracked successfully. Certain product categories, items, or order types may be excluded from cash back eligibility at the merchant's discretion.
Cash back transactions typically appear as "Pending" in your account within 24-72 hours of your purchase. Pending cash back reflects an unconfirmed transaction that has been reported by the affiliate network. Pending transactions are confirmed (or denied) after the merchant's return period has elapsed, typically 30-90 days. StackWell does not control the tracking or confirmation process and relies on data provided by third-party affiliate networks.
Cash back may fail to track or may be denied for various reasons, including but not limited to:
You may request a payout once your confirmed (non-pending) cash back balance reaches $10.00 or more.

Available payout methods may change. We reserve the right to add, modify, or discontinue payout methods at any time.
Payout requests are typically processed within 1-5 business days. Processing times may vary depending on the payout method and your financial institution. StackWell is not responsible for delays caused by payment processors, banks, or other third parties.
You are solely responsible for reporting and paying any taxes owed on cash back earnings. If your total cash back earnings exceed $600 in a calendar year, we may be required to issue a 1099-MISC or 1099-NEC tax form and report your earnings to the IRS. You agree to provide accurate tax identification information upon request.
You agree not to engage in any of the following prohibited activities:
Engaging in any prohibited activity may result in the suspension or termination of your account, forfeiture of pending and confirmed cash back balances, and legal action where appropriate.
If a qualifying purchase does not appear in your account within 72 hours, you may report it to us via the contact form. Reports must be submitted within 60 days of the purchase date and must include the order number, purchase date, and purchase amount. Resolution may take up to 30 business days. StackWell reserves the right to deny reports that cannot be verified.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. This includes changing cash back rates, adding or removing merchant partners, or modifying payout options. We will not be liable to you for any such modification, suspension, or discontinuation.
All content on the StackWell website is the property of StackWell or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or modify any content without our prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, STACKWELL DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. We do not warrant that cash back tracking will function correctly in all circumstances or that all transactions will be tracked and confirmed.
TO THE FULLEST EXTENT PERMITTED BY LAW, STACKWELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT OF CONFIRMED CASH BACK CREDITED TO YOUR ACCOUNT IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT.
You agree to indemnify, defend, and hold harmless StackWell, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service, your violation of these Terms, or any fraudulent or illegal activity conducted through your account.
We may suspend or terminate your account at any time, with or without cause. If your account is terminated for violation of these Terms, you forfeit all pending and confirmed cash back balances. You may close your account at any time by contacting us.
These Terms are governed by the laws of the State of New York. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and StackWell regarding the Service.
